Terms and Conditions
Hawaii Island Insider Tours LLC (doing business as HII Tours)
1. General Policy
All rentals, tours, and services provided by Hawaii Island Insider Tours LLC (the Company)
are subject to these Terms and Conditions. By booking or renting a vehicle, the renter
(Customer) confirms that they have read, understood, and agree to all terms on this page.
2. Eligibility
- Customer must be at least twenty one years of age with a valid driver license.
- An additional form of identification such as passport or state identification may be required.
- The renter must be the primary driver and the card holder used for payment.
- The Company may refuse service to any person for safety or policy reasons.
3. Payment
- All rentals require full payment in advance unless agreed in writing.
- A security deposit may be held to cover damage, cleaning, fuel shortage, or policy violations.
- Unpaid balances or damage may be charged to the card on file or pursued through collection or legal action.
4. Taxes and Fees
All rentals are subject to mandatory State of Hawaii and County of Hawaii taxes and fees:
- General Excise Tax (GET) at four percent of the taxable amount.
- Rental Vehicle Surcharge Tax (RVST) at five dollar and fifty cents per rental day.
- Any other local or airport related fee required by law or facility rules.
These taxes and fees are required by law and are not subject to negotiation or waiver.
5. Insurance and Responsibility
- The Customer is fully responsible for the vehicle from delivery until it is checked back in by the Company.
- Any damage, theft, loss, or misuse of the vehicle, regardless of fault, is the financial responsibility of the renter.
- If the Customer declines offered coverage, the Customer accepts one hundred percent responsibility for repair or replacement costs.
- Company insurance does not apply to negligence, off road driving, intoxication, or any use by a person not listed on the rental agreement.
- Vehicles may not be removed from the Island of Hawaii without written consent.
6. Prohibited Uses
The vehicle may not be used for any of the following:
- Off road driving, racing, towing, or carrying unsafe loads.
- Operation by any person under the influence of alcohol, drugs, or any impairing substance.
- Carrying more passengers than the number of seat belts installed in the vehicle.
- Subrental, rideshare work, or other commercial use not approved in writing by the Company.
- Use by any person not named as an approved driver in the rental documents.
Any prohibited use is a breach of this agreement and may result in immediate termination of the rental, forfeiture of all payments, and full financial liability for resulting loss.
7. Vehicle Condition and Return
- The vehicle must be returned in clean condition with the same fuel level as at checkout, unless otherwise noted.
- Smoking or vaping inside the vehicle is strictly forbidden. A cleaning fee of two hundred fifty dollars may be charged for any evidence of smoking or vaping.
- Lost keys, damaged tires, or missing accessories such as child seats or equipment are charged at full replacement cost.
- Late returns are charged at the daily rental rate plus any applicable late fees and taxes.
- A vehicle that is not returned within twenty four hours after the scheduled return time and not approved for an extension may be reported as stolen.
8. Late Return and Unauthorized Extension
- All extensions must be requested and approved at least twenty four hours before the scheduled return time.
- If the Customer keeps the vehicle beyond the return time without approval:
- A late return fee of one hundred fifty dollars per day will be charged, in addition to the full daily rental rate for each extra day.
- Applicable taxes and mandatory surcharges are added to these charges.
- After twenty four hours beyond the scheduled time without contact or approval, the Company may report the vehicle as stolen and begin recovery procedures.
- Any cost related to recovery, towing, storage, loss of use, and legal or collection fees will be charged to the Customer.
- Unauthorized possession or delayed return may void insurance coverage and is treated as a serious breach of contract.
9. Cancellation and Refund Policy
- Cancellations made seventy two hours or more before the rental start date may receive a full refund, less any card or processing fees.
- Cancellations made within seventy two hours of the rental start time are not refundable.
- No shows, early returns, and rentals ended because of policy violations are not refundable.
- If there are severe weather issues, mechanical issues, or safety concerns, the Company may, at its choice, offer a new date, a substitute vehicle, or a credit.
10. Liability and Indemnity
The Customer agrees to release, indemnify, defend, and hold harmless Hawaii Island Insider Tours LLC, its owners, partners, employees, and agents from all claims, demands, losses, damages, and expenses, including reasonable attorney fees, that arise from or relate to the use or operation of the rented vehicle or participation in any related activity.
The Company is not responsible for loss or damage to personal property, for weather delays, acts of nature, road closures, or actions of third parties.
11. Legal Terms and Venue
- This agreement is governed by the laws of the State of Hawaii.
- Any dispute must be brought in a court located in Hawaii County, State of Hawaii.
- The Customer agrees to pay all reasonable legal and collection costs incurred by the Company in enforcing this agreement.
12. Privacy
Personal information is collected for booking, billing, and communication only. The Company does not sell personal data. Information may be shared with banks, card processors, insurance providers, or law enforcement when required.
13. Acceptance
By booking, paying, or signing the rental documents, the Customer confirms that they have read and accept these Terms and Conditions. The Customer understands that violation of these terms may result in immediate termination of the rental and full financial responsibility for all related costs.
